Frequently Asked Questions
medical legal answers: Frequently Asked Questions

Why should I hire Medicine Man Consulting?

Our nurse consultants have years of experience in acute care settings and are experts in applicable standards of care. Many of our consultants actively work in an acute care setting, hold advanced certifications, and train new graduate nurses.

Founder and lead consultant, Pete Grant, has over 20 years of bedside clinical experience and completed much of his ICU training at The Mayo Clinic Hospital in Arizona. He has held a variety of nursing roles in the hospital setting, including clinical manager, charge nurse, house supervisor, clinical preceptor, rapid response nurse, and code blue team lead.

Pete has been providing expert witness services for the past 12 years and consulted on dozens of cases in the realm of wrongful death, catastrophic injury, falls, medication errors, sexual assault allegations, needle injury, failure to monitor, and inadequate documentation.

How do I know if my case has merit?

That’s what we’re here for! If you have any questions about the merit of your case, give us a call. We’ll have a brief phone consultation, free and with no further obligation. If it sounds like your case is a good fit for both of us, then we will move forward with a comprehensive record review and analysis report.

We’ll explore the allegations, either from a plaintiff or defense perspective. Highlight the deviations in the standard of care. List potential negligent parties. Explore the strengths, weaknesses, and potential pitfalls of the case. Make recommendations on expert witnesses you might want to involve.

What types of cases or clients do you specialize in?

Medicine Man Consulting provides services predominantly in medical malpractice litigation involving allegations against nurses. We have experience in both plaintiff and defense cases from many different states across the U.S.

Currently, we offer case consultations (merit reviews, analysis reports, deposition prep) in the following acute care settings: Medical/Surgical, Telemetry, Progressive Care / Cardiac Stepdown, Intensive Care Unit / Coronary Care Unit, and Post-anesthesia Care Unit (PACU).

Expert witness services are currently provided in the following areas: Intensive Care Unit.

Does Medicine Man Consulting use Artificial Intelligence to review medical records and generate reports?

The answer is no. We have real humans here who understand the complexities of being a patient or nurse in an acute care setting. Yes, AI has a profound capacity to process and extract data, that’s true. However, it is not a substitute for real nursing experience and insight.

AI-generated reports tend to contain an exorbitant amount of useless information, which, in the end, you spend more time sifting through to get to the meat of the case. Our merit reviews take you right to the good stuff.

How do you ensure confidentiality and compliance?

Medicine Man Consulting adheres to all HIPAA compliance regulations in accordance with federal law. All electronic files are accessed on HIPAA-compliant platforms (i.e., Dropbox). All employees and independent contractors providing services as agents of Medicine Man Consulting are required to comply with all HIPAA regulations and take appropriate security measures when handling client/case information.

What makes your consulting approach unique?

First and foremost, Medicine Man Consulting is not going to misrepresent the strength of your case when there are severe deficiencies. We will provide you with a very thorough and honest assessment, based on nationally accepted standards of care. Sometimes that means we must deliver bad news. We are always honest in our opinions because it’s an ethical thing to do, and we must be able to support our opinions should the case go to trial.

Medicine Man Consulting exists because we are passionate advocates for patients, families, and nurses.

How do you structure your fees?

Medicine Man Consulting services are provided through a signed fee agreement between the parties. The agreement is specific to the type of consulting services performed and is typically billed at an hourly rate, in quarter-hour increments. In all situations, a nominal retainer is required prior to any work being started.
